Consignment Terms & Conditions

1. Ownership & Authority

You certify that you are the legal owner of all items submitted or have full authority to consign them. Items must be free of liens, claims, or encumbrances. By submitting the intake form, you authorize Lotstream to act as your agent for sale and transfer of ownership upon successful auction.

2. Consignment Period

Items are consigned to Lotstream for a period of up to 30 days. During this time, Lotstream may photograph, list, promote, and sell items at its discretion through live-stream auction formats and other approved platforms. After 30 days, you may request the return of unsold items (shipping at your expense), or allow continued relisting by written agreement.

3. Streaming Sales Format

All sales take place on live-stream marketplaces, including Whatnot, eBay Live, Instagram, TikTok, and others as Lotstream may utilize. Prices are determined dynamically by live bidders. Lotstream does not guarantee any minimum sale price unless explicitly agreed upon in writing.


By consigning items to Lotstream, you grant us permission to photograph, stream, and publicly display your merchandise for the purposes of marketing, sales, or education. You retain ownership of unsold items unless and until sold.

4. Inventory Review, Disputes & Lot Approval

Once merchandise is picked up, received by mail at our warehouse, or dropped off at any authorized location, Lotstream will perform an initial intake review. A complete inventory list will be sent to the consignor via email and/or text within 3 to 7 business days.


The consignor has 48 hours to:

  • Confirm the inventory

  • Dispute missing or damaged items

  • Request minimum bids (reserves) on individual lots


If no response is received within 48 hours, the list is considered accurate and approved for sale. To initiate corrections, email support@justlotstreamit.com.


Most inconsistencies are resolved easily; however, if claims involve significant loss, damage, or insurance, a resolution period of up to 45 daysmay be required for investigation and claim processing.

5. Commission Structure

Lotstream applies commission based on two factors:


5a. High-Value Lot Incentives (Per-Lot Override)

Preferred commission rates apply to individual lots that meet the following thresholds:

  • 5% commission for any lot sold over $2,000

  • 10% commission for lots sold between $1,000–$2,000


These rates apply only to qualifying lots. All other lots follow the volume-based commission tiers.


5b. Monthly Volume-Based Commission (Applied Incrementally)

All other items are subject to the following tiered structure, based on total monthly realized sales:

  • 30% on the first $100,000

  • 29% on the next $150,000 ($100,001–$250,000)

  • 28% on the next $250,000 ($250,001–$500,000)

  • 27% on the next $250,000 ($500,001–$750,000)

  • 26% on the next $250,000 ($750,001–$1,000,000)

  • 25% on all sales above $1,000,000


Each tier is applied incrementally. Preferred rates (Section 5a) reduce the consignor's effective commission for the month.


Payout Method & Reporting: Payouts are issued via ACH transfer or business check. A digital sales summary including lot numbers, realized prices, and commission breakdowns will be provided within 48 hours of payout.

6. Item Valuation & Insurance Thresholds

Lotstream insures all inbound shipments through its corporate policy up to $25,000 per package. If you are sending an item or combined package exceeding that value, you must notify us prior to shipping for supplemental insurance.


Lotstream is not responsible for loss of numismatic or collectible value due to cosmetic changes or handling, unless due to gross negligence or willful misconduct.

7. Loss, Damage & Liability

Once in our possession, items are stored securely and monitored. Lotstream is not liable for minor cosmetic wear occurring during intake, imaging, or handling. For major loss or damage, liability is limited to the insured value.

8. Prohibited Items & Marketplace Compliance

Lotstream complies with policies of all platforms we sell on, including Whatnot, eBay, Instagram, TikTok, and others.


We do not accept items that violate marketplace, legal, or shipping regulations, including:

  • Counterfeit or infringing goods

  • Stolen or misrepresented merchandise

  • Weapons, firearms, explosives, drugs, or paraphernalia

  • Hate-related, violent, or culturally offensive items

  • Human remains or body parts

  • Sexually explicit materials

  • Prohibited animal products or plants

  • Recalled items

  • Hazardous materials or flammables


Items violating eBay's, Instagram's, TikTok's, Facebook's, and Whatnot's Prohibited Items Policies. By submitting our intake form and consigning items to Lotstream, you agree to the following terms: related to hate speech, racial or cultural insensitivity, or historical artifacts deemed inappropriate under marketplace standards will be removed. Lotstream reserves the right to reject or remove any item at its sole discretion.

9. Returns, Cancellations & Unsold Items

Buyer-canceled or returned items will be automatically relisted in the next available show, unless:

  • The item was damaged, lost, or mis-shipped

  • The item violated platform or legal policies

  • The reserve was deemed unrealistically high


Lotstream does not charge back consignors for buyer cancellations unless the item was unsellable, materially misrepresented, or in violation of policy.

Items that remain unsold after 30 days may be:

  • Returned to the consignor (shipping at their expense)

  • Repriced or bundled for sale

  • Relisted beyond 30 days with written consent

10. Clothing Condition Requirements

Clothing items must meet the following minimum standards unless flaws are disclosed:

  • Clean and free of odors

  • Pressed or wrinkle-free

  • Near mint condition (no major stains, tears, excessive wear)

  • Free of pet hair or debris

  • Alterations must be disclosed


Lotstream reserves the right to:

  • Charge garment prep fees ($2–$4 per item)

  • Return items at consignor’s expense

  • Reject items that do not meet quality standards

11. Collectibles Condition & Packaging Guidelines

Collectibles (coins, trading cards, toys, comics, etc.) must:

  • Be clean and complete relative to category

  • Include original packaging when applicable

  • Disclose visible flaws or prior alterations


Lotstream may bundle, adjust pricing, or reject items based on resale potential or buyer trust.

12. Agreement & Electronic Consent

By checking the acceptance box during the intake form submission, you agree to these terms and enter into a legally binding agreement under the ESIGN Act. Lotstream may update terms periodically. Material changes(e.g., commissions, payouts, liability terms) will be communicated via email or website posting. Continued use of our service constitutes acceptance of these changes.

13. Dispute Resolution

If a dispute arises related to these terms, Lotstream and the consignor agree to first attempt to resolve it through good-faith negotiation. If unresolved within 15 business days, the dispute will be submitted to binding arbitration in San Francisco, California, under the rules of the American Arbitration Association. Each party will bear its own legal costs.

14. Consignor Responsibility Summary

As a consignor, you are responsible for submitting items you legally own, disclosing flaws, confirming inventory within 48 hours, and complying with platform and legal standards. You agree to Lotstream’s commission and return policies, and understand that prohibited, misrepresented, or unsellable items may be declined, returned, or charged back.
